ASP: means ASP Vehicle Rentals limited who trade as ASP Car Hire or ASPcarhire.com. ASP Car Hire is registered in the Isle of Man at The Park Balthane Estate Isle Of Man, IM9 2AH
Customer: means the main person who is the hirer and driver of our vehicle.
When you’re driving an ASP rental vehicle, it’s crucial to ensure that you’re financially protected if things go wrong. One vital piece of financial protection is our Loss & Damage Waiver (LDW). ASP offer a Loss and Damage Waiver as an upgraded term to the offer of the hire. This is not an insurance product but a commercial term that offers financial protection and risk reduction to our customer.
These terms set are your guide; we’ll comprehensively break down what LDW cover is and how it affects you when you hire our vehicles.
1. What is a Loss & Damage Waiver (LDW)?
A Loss & Damage Waiver is a beneficial term incorporated into the hire that reduces your liability for damages to our rental vehicle. It can come into effect if your vehicle is damaged or lost.
A LDW is not “insurance”. It’s a commercial term that transfers the first part risk of financial loss of damages from you to us the rental company. Therefore ASP Car Hire waives the right to hold you liable for vehicle damages, for the first loss to a limited extent.
2. What do Loss & Damage Waivers cover?
The ASP Loss & Damage Waivers protects the customer and authorised drivers in the event of a loss or damage where the driver acted reasonably, and the loss or damage was not an exempt reason see section 3 of these Terms and Conditions. LDW will cover incidents such as
- Single vehicle accidents.
- Theft or loss protection.
- Optional extras like scratches and bumps to the main body of a vehicle.
- Or loss or damage incidents where the cause is not as a result of the negligence of the driver or an authorised driver.
ASP offer our best coverage on a single plan, with no extras and no add-ons. Keep your cover simple and enjoy travelling in a rental car with peace of mind.
3. What do Loss & Damage Waivers not cover?
Your LDW does not cover any loss for the following:
1. Your personal belongings or property or accessories you rent in addition to the vehicle (e.g. portable navigation units, portable WiFi units, child seats, etc.). You will be charged for replacement of these items if they are lost or damaged for any reason.
2. Removable parts of the vehicle if they are missing at time of return such as keys and key fobs, luggage covers and nets, charging cables for PHEV or EV’s, warning vests and triangles, SD GPS cards, spare wheels, tools and tyre inflation devices, 1st aid boxes, fire extinguishers, etc. You will be charged for replacement of these items unless the vehicle was involved in an accident or third-party theft.
Please note your liability for damage to, or loss of, the vehicle will not be waived or if the loss or damage was an act of you or an authorised driver’s negligence. Such acts of negligence include but are not limited to the following:
3. where you or the authorised driver are in breach of your obligations under the ASP Rental Agreement.
3.1 If the loss or damage is caused intentionally or you or any authorised driver misled ASP or deliberately failed to provide information that was relevant to the loss or damage.
3.2 If the driver or person in charge of the vehicle was not authorised by ASP as the main or additional driver; or
3.3 If the main or the additional driver drives in a negligent manner including failure to assess the vehicle’s height, driving on unsuitable road conditions, improper use of the vehicle, contribution to damage to/theft of the vehicle)
3.4 Where the driver or the authorised driver of the vehicle was involved in the loss or damage incident whilst under the influence of drugs or alcohol or driving the vehicle in an unlawful manner e.g. speeding or reckless driving.
3.5 Driving off road or on a beach causing damage by salt water and/or sand; or driving through flooded roads causing damage to the engine.
3.6 Putting wrong fuel in the vehicle or otherwise contaminating the fuel.
3.7 Damage occurring because of ignoring a warning light or signal.
3.8 Burning a clutch (which requires persistent ill use) or using the handbrake incorrectly.
3.9 Damage to the wheel rim caused by driving with a flat tyre.
3.10 Carrying especially dirty or smelly materials that require extra cleaning costs or that damage or burn the vehicle.
3.11 Damage or resulting from locking the keys in the vehicle or losing the keys
3.12 Loss of the vehicle caused by failure to use the anti-theft system or leaving the vehicle un locked (if provided);
3.13 Loss of the vehicle when you are unable to return the key.
3.14 Fixed penalty notice payments or parking fines or any other statutory fine issued to the vehicle because of a driver’s actions.
4. Is a Loss & Damage Waiver worth it?
When ASP provide you a quote for renting a car, we have already included the LDW cost so there is nothing extra for a customer to pay. ASP’s LDW covers up to the first £1,000 of loss or damage costs incurred on our vehicles subject to the exclusion in part 3. loss or damage cost in excess of the £1,000 are covered under our insurance subject to the cause not being an exclusion in part 3.
5. How much is Loss Damage Waiver?
ASP will always try and deal with customers fairly and be transparent therefore the cost quoted in your rental already includes the cost of LDW. Customers can choose to remove the cost of the LDW and the cost will be reduced by:

6. How do I remove the LDW cost from my hire
Simply ask us to remove the LDW cost from your hire agreement. Your fees will be adjusted. If you choose to remove LDW then you will be required to provide a deposit for the sum of £1,000 this will be refunded to you within 3 working days of the end of the hire period and return of the vehicle to us providing there are no loss or damage to the vehicle that would have been covered had the LDW cover been in place.
If you have paid the deposit, you will be required to agree to allow us to recover any loss or damage costs up to the £1,000 you have deposited. Deposits can be secured against a credit card that belongs to the driver or authorised driver.
7. Exclusions to LDW
Corporate customers who rent vehicles and insure the hired vehicle under their own corporate insurance policy will not benefit from the ASP LDW cover and will be responsible for all loss or damage directly or through their insurance policy.
8. How to claim using ASP’s LDW cover
The following procedure must be followed by the customer to make a claim failure to do so can result in the LDW cover being withdrawn and you the customer being liable for the loss and damage incurred.
1. The customer must notify ASP as soon as practical when they become aware of an event that may give rise to a claim.
2. The customer should collect all information and evidence such as video or photographs or details of any other parties such tother drivers or police or Isle of Man Government authorities.
3. The customer must complete the Loss & Damage Form available from ASP office or online at aspcarhire.com
4. Please contact the ASP team if you require any information or assistance in making or advising us of a possible loss or damage.
5. The customer is required to provide all reasonable cooperation to ASP in the process of making a claim or a subsequent insurance claim.
